What is Marriage Equality?

Marriage equality refers to the legal recognition of marriages between individuals of diverse sexual orientations, extending beyond the traditional definition of unions between a man and a woman. It ensures that same-sex couples, whether women or men, receive equal legal protection under the principles of equality and human rights.

The Journey of the Marriage Equality Act

The push for marriage equality in Thailand began 23 years ago during the administration of former Prime Minister Thaksin Shinawatra, when the Ministry of Interior first introduced the concept. However, societal resistance at the time stalled its progress.

Fast forward to 2020, when the Move Forward Party resubmitted a draft of the Marriage Equality Act to Parliament. The proposal passed its first reading alongside three other gender equality-related bills aimed at removing barriers to marriage registration and equal rights for couples. These laws were designed to ensure that all couples—regardless of gender identity—are granted the same legal rights and benefits as heterosexual couples.

The Act introduces amendments to legal terminology to promote inclusivity and equity, allowing any consenting adults to marry without restriction based on gender.

Importance of Marriage Laws

  1. Marriage is not restricted to only male and female couples; people of any gender identity can register their marriage.
  2. Regardless of the gender identity of the spouses, once they register their marriage, they are considered legally married.
  3. Individuals can marry if they are at least 18 years old. (If under 20, legal guardians’ consent is required.)
  4. Gender-specific terms have been changed to be more neutral, such as replacing “husband and wife” with “spouses,” “male and female” with “individuals,” and “father and mother” with “parents.”
  5. The right to manage marital property.
  6. The right to inherit property if a spouse passes away.
  7. The right to act as a legal representative in criminal matters, similar to that of a husband and wife.
  8. The right to consent to medical treatment on behalf of the spouse.
  9. The right to receive social security benefits.
  10. The right to file joint tax returns.
  11. The right to manage funeral arrangements. 
  12. The right to adopt children and allow the adopted child to use the spouse’s surname, provided the adopter is at least 15 years older than the adopted child.
